Description
Published for the first time in 1987 in the collection "Pratiques théoriques", this work places the Code Noir in its theological, philosophical and legal filiation. It confronts it with the realities of slavery and the philosophical criticism of its time, whose limits it cruelly marks. In 2001, France qualified the slave trade and slavery as a "crime against humanity" by law. This is a crime for which there is no statute of limitations. But explicitly choosing to ignore what "imprescriptibility" means, the legislator refused to answer three questions: what should be repaired, who should repair it, and how to repair it?
